EFFECTIVE DATE: July 21, 2022 Miller’s Ale House, Inc. (“we,” “us,” or “our”) values your privacy. In this Privacy Policy (“Policy”), we describe how we collect, use, and disclose information that we obtain about visitors to our website www.millersalehouse.com or other websites (including those hosted or managed by our service providers) where we post this Policy (the “Sites”), users of our mobile Application (including those applications hosted or managed by our service providers) (the “Apps”), and the services available through the Sites and Apps (collectively, the “Services”), and how we use and disclose that information. By visiting the Sites, or using any of our Services, you agree that your personal information will be handled as described in this Policy. Your use of our Sites or Services, and any dispute over privacy, is subject to this Policy, our Terms of Service, and our Public Wi-Fi Terms of Use, including any applicable limitations on damages and the resolution of disputes. The Miller’s Ale House Terms of Service are incorporated by reference into this Policy.

The Information We Collect About You

We collect information about you directly from you and from third parties, as well as automatically through your use of our Sites or Services.

Information We Collect Directly From You

The type of information we collect from you depends on your interaction with our Sites and our Services. Certain areas and features of our Site and Services require registration. To register for our Raving Fans Club, eClub or other rewards programs we may offer, you must provide your name, zip code, email address, and date of birth. If you contact us, we collect your name, email address, phone number, and any information that you choose to provide to us.

If you place an online order through the Services, we or our service provider (on our behalf) will collect your name, email address, phone number, location (for delivery orders), information about the menu items you considered, your order and payment information, and, if you choose to create an account for future orders, your password.

Information We Collect From Third Party Sources

We may collect information about you from marketing companies or social networks. For example, we will collect the information that you post on our social media accounts, such as our Facebook and Twitter pages, or information from posts you make about us on consumer review services, such as Yelp and TripAdvisor.

Information We Collect Automatically

We automatically collect the following information about your use of our Services through cookies, web beacons, and other technologies, including technologies designed for mobile applications: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Site and or use our Services; and the referring URL, or the webpage that led you to our Site; your mobile device IDs, device name and model; device language preferences; and activities within the App and the length of time you use or are logged into our App. We may combine this information with other information that we have collected about you, including, where applicable, your name, and other personal information Please see the section “Cookies and Other Tracking Mechanisms” below for more information.

Information We Collect Through Our Public Wi-Fi

If you sign on to our public Wi-Fi network at a Miller’s Ale House location, we will collect your device identifier, MAC address, IP Address, information about how you use our network, and information about the websites and applications you use while connected to our network. When we collect your IP Address, we will assign it a unique identifier to recognize when that mobile device visits one of our locations.

How We Use Your Information

We use your information, including your personal information (collectively, “information”), for the following purposes:

To provide our Services to you, to communicate with you about your use of our Services, to respond to your inquiries, to fulfill your orders, and for other customer service purposes.

To tailor the content and information that we may send or display to you, to offer location customization, and personalized help and instructions, and to otherwise personalize your experiences while using the Services.

For marketing and promotional purposes. For example, we may use your information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you. We also may use the information that we learn about you to assist us in both our online and offline advertising of our Services and other offerings.

To better understand how users access and use our Services, both on an aggregated and individualized basis, in order to improve our Services and respond to user desires and preferences, to develop new services and offerings, and for other research and analytical purposes.

To administer our Raving Fans Club, eClub, or other loyalty, rewards or other promotional programs we may offer from time to time.

To administer surveys and questionnaires, such as for user engagement, market research or customer satisfaction purposes.

To share your reviews and comments about us that we collect from social media and consumer review services.

To provide our Public Wi-Fi service, to recognize returning Public Wi-Fi users at our locations, and to ensure users comply with our Public Wi-Fi Terms of Use.

To create aggregated, anonymized, pseudonymized or de-identified data sets. We may use such data sets for any purpose, including product improvement and development, marketing, advertising, trend analysis and other purposes.

To comply with applicable legal obligations, including to respond to a subpoena or court order, and as part of our general business operations and business administration.

Where we believe it is necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person or property, or violations of our Terms of Use or this Policy.

How We Share Your Information

We may share your information, including personal information, as follows:

Social Media Posts. We may share comments and reviews you post to social media about us on the Site. If we post your review or comments, we will share your name or your social media user name and your comments about us.

Affiliates. We may disclose the information we collect from you to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your personal information will be subject to this Policy.

Service Providers. We may disclose the information we collect from you to vendors, service providers, contractors or agents who perform functions on our behalf.

We may also share personal information for the following purposes:

Business Transfers. If (i) we or our affiliates are or may be acquired by, merged with, or invested in by another company, or (ii) if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected about you to the other company. As part of the business transfer process, we may share certain of your personal information with lenders, auditors, and advisors, including attorneys and consultants.

In Response to Legal Process. We also may disclose the information we collect about you in order to comply with the law, a judicial proceeding, court order, law enforcement request, or other legal processes, such as in response to a court order or a subpoena.

To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which Company is involved.

Aggregate and De-Identified Information. We may share aggregate, anonymized, pseudonymized, or de-identified information about users with other parties for marketing, advertising, research or similar purposes.

Special Notice for Nevada Consumers. Nevada law allows consumers to direct certain businesses not to sell their personally identifiable information to third parties to license or sell that information to additional third parties. Millers does not currently sell data of Nevada consumers for monetary compensation. If you are a Nevada resident, you may submit such opt-out requests to [email protected]. To be effective, your request must include your full name, address, phone number, and email address [or other information reasonably necessary to verify the authenticity of the consumer request]. Millers will endeavor to respond to your verified request within 60 days of receiving the request.

However, due to unforeseen circumstances, Millers may need to extend this period by up to 30 days. If an extension is reasonably necessary, Millers will notify you of this during the initial 60-day period.

Our Use of Cookies and Other Tracking Mechanisms

We and our service providers use cookies and other tracking mechanisms to track information about your use of our Sites, App, or Services. We may combine this information with other personal information we collect about you (and our service providers may do so on our behalf).

Cookies

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Site and Service. There are two types of cookies: session and persistent cookies.

Session Cookies

Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Sites. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Sites.

Persistent Cookies

Persistent cookies remain on your device after you have closed your browser or turned off your computer. We use persistent cookies to track aggregate and statistical information about user activity.

Disabling Cookies

Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Sites who disable cookies will be able to browse certain areas of the Sites, but some features may not function.

Clear GIFs, pixel tags and other technologies

Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Services to, among other things, track the activities of Site visitors, help us manage content, and compile statistics about Site usage. We and our service providers also use clear GIFs in HTML e-mails to our customers, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

Analytics

We use automated devices and applications, such as Google Analytics, to evaluate usage of our Sites and, to the extent permitted, our Application. We also may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services. To learn more about Google’s privacy practices, please review the Google Privacy Policy. You can also download the Google Analytics Opt-out Browser Add-on to prevent their data from being used by Google Analytics.

Do-Not-Track

Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies); you also may opt-out of targeted advertising by following the instructions in the Ad Network section.

Ad Networks

We may use network advertisers to serve advertisements on unaffiliated websites and other media (e.g., social networking platforms). This enables us and these network advertisers to target advertisements to you for products and services in which you might be interested, including our own. Ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These cookies and other technologies are governed by each entity’s specific privacy policy, not this one. We may provide these parties with information, including personal information about you, as part of our advertising efforts.

We may disclose certain information (such as your email address) to Ad Networks we work with so that we can better target ads and content to you and others with similar interests on other websites or media (“Custom Audiences”). We may also work with other ad networks and marketing platforms that enable us and other participants to target ads to Custom Audiences submitted by us and others. You may also control how ad networks display certain ads to you, as explained further in their respective privacy policies or by using the opt-outs described below.. Users in the United States may opt out of many third-party ad networks.

For example, you may go to the Digital Advertising Alliance (“DAA”) CONSUMER CHOICE PAGE for information about opting out of interest-based advertising and their choices regarding having information used by DAA COMPANIES. You may also go to the Network Advertising Initiative (“NAI”) CONSUMER OPT-OUT PAGE for information about opting out of interest-based advertising and their choices regarding having information used by NAI MEMBERS. Mobile application users may also download the APP CHOICES tool to manage interest-based advertising on their mobile device. Opting out from one or more companies listed on the DAA CONSUMER CHOICE PAGE or the NAI CONSUMER OPT-OUT PAGE will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our Site or on other websites.

You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective. Our Services may contain links to non-affiliated websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those websites. We are not responsible for the information practices of such websites.

Security of My Personal Information

We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee security.

What Choices Do I Have Regarding Use of My Personal Information?

We may send periodic promotional or informational emails to you. You may opt-out of promotional communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any services you have requested or received from us.

Children Under 13

Our Services are not designed for children under 13. If we discover that a child under 13 has provided us with personal information, we will delete such information from our systems.
